Welcome to Style Majix. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of our website, digital platforms, and online storefront (collectively, the "Site"), as well as any purchases of hair styling tools, accessories, or related products (the "Products") offered by Style Majix ("we", "us", or "our").

Please read these Terms carefully before accessing or using our Site. By visiting our Site or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms and Conditions, including any additional terms, conditions, and policies referenced herein or available via hyperlink (including our Shipping & Refund Policy).

If you do not agree to all the terms and conditions of this Agreement, you may not access the website or use any of our services.

1. General Overview & Eligibility

  • Eligibility: By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Site.

  • Domestic Operations Only: Style Majix operates exclusively within the fifty (50) United States and U.S. Territories. We do not solicit orders, ship, or knowingly market our products outside these jurisdictions.

  • Modifications: We reserve the right to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Product Safety, Use & Disclaimers for Electrical Hot Tools

Style Majix designs and retails high-performance electrical hair styling appliances (e.g., flat irons, curling wands, blow dryers, and heated styling brushes). High operating temperatures are inherent to the operation of these devices.

  • Manufacturer Instructions: You agree to read, understand, and strictly adhere to all user manuals, warning labels, safety guides, and operational instructions included in the packaging prior to plugging in or operating any styling tool.

  • Electrical Safety: Our products are manufactured to standard U.S. electrical specifications (typically 110–120V, 60Hz unless expressly marked as universal dual voltage). Connecting tools to incorrect voltages, foreign power adapters, or non-certified voltage converters presents severe fire, burn, and electrocution hazards and will void all protections or remedies.

  • Burns and Heat Hazard: Electrical styling tools produce extreme temperatures capable of causing severe burns to skin, scalp, and eyes, or igniting flammable materials. Always place heated tools on heat-resistant surfaces, disconnect tools immediately after use, and keep them completely out of reach of children and pets. Never immerse tools in water or use them in close proximity to bathtubs, sinks, or standing water.

  • Professional and Personal Judgment: Hair textures and health vary significantly. You are solely responsible for determining whether a specific heat setting or styling technique is appropriate for your hair type. Style Majix is not liable for thermal damage, breakage, discoloration, or adverse reactions resulting from misuse, excessive heat exposure, or improper styling techniques.

3. Online Store Terms & Account Responsibilities

  • Prohibited Conduct: You may not use our products or Site for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright, patent, or consumer safety laws).

  • Account Security: If you create an account on our Site, you are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account.

  • Breach: A breach or violation of any of these Terms may result in the immediate suspension or termination of your account and access to our Services.

4. Accuracy of Billing and Account Information

  • Right to Refuse or Cancel Orders: We reserve the right to refuse, limit, or cancel any order placed with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, credit card, and/or orders that use the same billing or shipping address.

  • Reseller Prohibition: We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by unauthorized dealers, resellers, or commercial distributors.

  • Accurate Data: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

5. Pricing, Product Descriptions & Availability

  • Price Changes: Prices for our products are subject to change without prior notice.

  • Modifications to Service: We reserve the right at any time to modify or discontinue any Product, feature, or service without notice at any time.

  • Visual Representation: We make every effort to display the colors, finishes, and dimensions of our styling tools as accurately as possible. However, we cannot guarantee that your device's display monitor will accurately reflect the true color or finish of the physical product.

  • Typographical Errors: In the event that a product is mistakenly listed at an incorrect price or with incorrect specifications, we reserve the right to refuse or cancel any orders placed for products listed at the incorrect price, whether or not the order has been confirmed and your payment processed. If your payment has already been processed, we will promptly issue a full refund to your original payment method.

6. Shipping, Delivery & Geographical Limitations

All transactions and shipments are governed by our Shipping & Refund Policy, which is incorporated by reference into these Terms. Key shipping provisions include:

  • Geographic Scope: We ship exclusively to addresses located within the fifty (50) United States and U.S. Territories (including APO/FPO and P.O. Boxes). We do not ship to international destinations or domestic freight forwarding facilities intended for export.

  • Title & Risk of Loss: All purchases made through Style Majix are executed pursuant to a shipment contract. This means that the risk of loss and title for items pass to you upon our delivery of the package to the carrier (USPS, UPS, FedEx).

  • Delivery Dates: Shipping windows, dispatch estimates, and transit times displayed on the Site are estimates provided by postal and private freight carriers and are not binding guarantees.

  • Missing or Damaged Parcels: Any damage sustained during transit or issues with misdelivered/missing parcels must be reported to support@mybeautysite.com within the specific timeframes detailed in our Shipping & Refund Policy.

7. Returns, Refunds & Hygiene Policy

Style Majix enforces a strict 14-day return window and rigorous sanitary standards due to the personal-care nature of electrical hair tools:

  • 14-Day Limit: Return authorization requests must be submitted within 14 calendar days of verified carrier delivery.

  • Condition Requirements: To be eligible for a refund, tools must be clean, fully operational, in like-new cosmetic condition, and returned in their complete original retail packaging with all cord wraps, manuals, and accessories included. Tools exhibiting product buildup, scorched surfaces, singed hair, scratches, or missing parts will be denied.

  • Restocking & Shipping Fees: Unless an item is proven defective upon arrival or sent in error, outbound shipping costs are non-refundable, and return shipping fees will be deducted from your final refund amount.

  • Final Sale Items: Consumables (e.g., opened serums, sprays, oils), clearance/as-is merchandise, and gift cards are strictly non-refundable.

8. Intellectual Property Rights

  • All content on this Site—including but not limited to styling guides, product descriptions, photography, graphic designs, logos, button icons, audio/video clips, digital downloads, software, and brand names—is the property of Style Majix or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.

  • The name Style Majix, our logos, slogans, and product names are proprietary trademarks. You may not use, reproduce, duplicate, copy, sell, or exploit any portion of our intellectual property without express written permission from Style Majix.

9. Third-Party Links & Tools

  • Certain content, products, and services available via our Service may include materials from third parties (e.g., payment gateways, shipping aggregators, review widgets).

  • Third-party links on this site may direct you to external websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party sites, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

10. User Comments, Feedback & Submissions

If you send certain specific submissions (e.g., contest entries) or submit product reviews, customer testimonials, suggestions, styling videos, or other materials online or via email (collectively, "Comments"), you grant Style Majix a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, edit, publish, translate, and distribute such Comments across any media. We are under no obligation to maintain any Comments in confidence, to pay compensation for Comments, or to respond to Comments.

11. Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN WRITING BY STYLE MAJIX, THE SITE, ALL PRODUCTS SOLD THEREIN, AND ALL SERVICES RENDERED ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT ANY WARRANTIES, REPRESENTATIONS, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMISSIBLE BY APPLICABLE LAW, STYLE MAJIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT YOUR USE OF OUR SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STYLE MAJIX, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM:

  1. YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PRODUCTS PURCHASED FROM US;

  2. ANY THERMAL, PHYSICAL, OR ELECTRICAL DAMAGE RESULTING FROM MISUSE, LACK OF HEAT PROTECTION, IMPROPER VOLTAGE CONNECTION, OR FAILURE TO FOLLOW OPERATING MANUALS;

  3. ANY DELAYS, NONDELIVERY, OR ERRORS CAUSED BY THIRD-PARTY SHIPPING CARRIERS; OR

  4. ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00 USD) OR THE AMOUNT YOU PAID TO STYLE MAJIX FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Some state jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply in full to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Style Majix and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, and employees from any claim, demand, liability, loss, or expense (including reasonable attorneys' fees) made by any third party due to or arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your unauthorized or improper use/operation of any electrical styling tool.

14. Dispute Resolution & Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

  • Informal Resolution: Before initiating formal legal proceedings, you and Style Majix agree to make a good-faith effort to resolve any dispute, controversy, or claim informally by sending written notice to support@mybeautysite.com.

  • Binding Arbitration: If the dispute is not resolved within sixty (60) days, you agree that any dispute arising out of or relating to these Terms, the Site, or the purchase of Products shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Class Action Waiver: YOU AND STYLE MAJIX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING.

15. Governing Law & Jurisdiction

These Terms and any separate agreements whereby we provide you Products or Services shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. To the extent court proceedings are permitted, you and Style Majix submit to the personal and exclusive jurisdiction of the state and federal courts located in Fulton County or DeKalb County, Georgia.

16. Severability & Entire Agreement

  • Severability: In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of any remaining provisions.

  • Entire Agreement: These Terms, together with our Shipping & Refund Policy and any policies posted by us on this Site, constitute the entire agreement and understanding between you and Style Majix, superseding any prior or contemporaneous agreements, communications, and proposals (whether oral or written).
